Kokomo man pleads guilty to sexual battery

A Kokomo man who was arrested for child molestation in December of last year pleaded guilty to sexual battery to a minor Thursday afternoon and sentenced to two years in the Miami County Jail.

Randall Mitchell, 34, was arrested on Dec. 13, 2017 after being caught inappropriately touching a child under 12 years of age. The child in question was one whom Mitchell had a trusting relationship with and had been in the presence of on several occasions.

Mitchell was initially charged with a level 4 felony count for child molesting and, in July 2018, received an additional charge for a level 6 felony of sexual battery.

After several months of pretrial conferences, Mitchell appeared in court Thursday alongside his attorney William Berkshire in order to plead guilty.

Mitchell’s guilty plea agreement proposed he would plead guilty to the level 6 felony charge for sexual battery and, in return, the level 4 felony charge for child molesting would be dismissed.

The agreement also proposed Mitchell be sentenced to two years in the Miami County Jail and pay all court fines.

Following further discussion of the guilty plea agreement, Mitchell pleaded guilty to the level 6 felony charge for sexual battery at which time Miami County Circuit Court Judge Timothy Spahr accepted Mitchell’s plea agreement and found him guilty.

Mitchell was sentenced to two years in the Miami County Jail, however, with good time credit considered Mitchell is slated to be released in December.

Mitchell also has to pay $185 in court cost and an additional $500 in sexual assault fees. He was also mandated to register as a sex offender for life.

The guilty plea agreement was arranged by both Berkshire and Miami County Prosecutor Jeff Sinkovics as well as the victim’s family.
